How to Decide:  Duty to Warn vs Duty to Protect
Friday, November 19, 2021, 8:30 AM - 11:45 AM EDT
Category: LPCA Sponsored NBCC approved

This is a live, synchronous webinar for 3.0 Ethics Hours.  The purpose of this workshop is to educate professional counselors on the definitions of "duty to warn" and "duty to protect statutes" in Georgia.  Participants will learn the defining differences in the two statutes and applicable codes of ethics in the counseling profession.  Participants will learn the timeline for the establishment of "duty to warn" and "duty to protect"  as legal statutes and case laws both nationally and in Georgia. In addition, discussions will include the historical and current perspectives in Georgia on breaching confidentiality when a client threatens to do harm to another.  Participants will participate in triads to demonstrate their understanding and application of the statutes, codes of ethics, and ethical decision making models when faced with potentially dangerous clients.

Learning objectives:

  1. Participants will be able to verbalize the difference between “a duty to warn” and a “duty to protect”.
  2. Participants will be able to discuss applicable codes of ethics and laws related to a “duty to warn” and “a duty to protect”.
  3. Participants will be able to demonstrate the use of an ethical decision-making model to discern if there is “a duty to warn” or “a duty to protect” when working with a client who threatens harm to others.
